SPECLO Pty Ltd (ABN 67 691 028 967) ("SPECLO", "we", "us" or "our") is committed to protecting the privacy of personal information. This Privacy Policy explains how we collect, hold, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs").

This Privacy Policy applies to all personal information collected by SPECLO, including personal information collected in connection with our mobile application available on iOS and Androids (“SPECLO App”), our website (available at www.speclo.com.au) (“SPECLO Website”) and related services provided by SPECLO (together, “Services”).

By using our Services, or by providing us with your personal information, you consent to the collection, use, storage and disclosure of your personal information in accordance with this Privacy Policy. We encourage you to read this Privacy Policy carefully and contact us if you have any questions.

For the purposes of this Privacy Policy, “personal information” and “sensitive information” have the same meanings that such terms have under the Privacy Act.

2. What Personal Information Do We Collect?

The types of personal information we may collect about you depend on your interactions with us, including whether you are a customer, product user, service provider, employee or other third party. The personal information we collect includes:

  • Identity and Contact Information: Your full name, email address, date of birth, phone number and gender;
  • Location Information: Your geographical location, including the location of the gym facilities you use and other location data collected through the SPECLO App and other Services;
  • Workout Information: fitness and workout information provided by you or generated through your use of the SPECLO App, including fitness goals, training preferences, workouts completed and duration of workouts;
  • Technical Information: Information collected from your visits to the SPECLO Website and SPECLO App, including your IP address, browser type, device information, operating system, login details, pages visited, time spent on pages and other usage data;
  • User Generated Content: Any content or material you publish or upload such as posts, messages, images, audio, hashtags/tags, photos or videos on our Services;
  • Image or Likeness: Your visual image or likeness (e.g., photographs, video and/or CCTV) if you visit our premises;
  • Cookies and Similar Technologies: Information through cookies and similar technologies, further details of which are set out in section 15 below;
  • Feedback and Support Communications: Any details of your communications/interactions with us, including when you call, email, live chat, video call or text with our support teams or communicate with us via social media channels or community forums; and
  • Other information: Any other personal information that you may provide to us in connection with your use of our Services and / or other contact that you have with SPECLO.

We may also collect certain information related to your health (including height, weight and fitness level), which is sensitive information. We generally only collect sensitive information with your consent, where it is reasonably necessary for our functions or activities and where the collection is permitted by law, including under the Privacy Act.

We do not currently collect biometric information. If we ever do, we will update this Privacy Policy and obtain your consent before collecting such information.

3. How Do We Collect Personal Information?

We collect personal information in a variety of ways, including:

  • Directly from you: When you register for an account, complete our forms, communicate with us, use our Services, upload or publish any information or material using our Services, or otherwise provide information to us directly;
  • Through our website and mobile application: We may collect information automatically when you visit the SPECLO Website or use the SPECLO App, including through the use of cookies, Google Analytics, Sentry, web beacons and similar technologies. These technologies help us understand how you use our services and improve your experience; and
  • From third parties: We may collect personal information from third party service providers, business partners, gym operators and other sources where you have consented to the disclosure of your information to us or where the collection is otherwise permitted by law.

4. Cookies and Similar Technologies

The SPECLO Website and SPECLO App use cookies, Google Analytics, Sentry, web beacons and similar technologies to enhance your experience, maintain security and collect information about how our Services are used. The way these technologies operate depends on whether you are using the SPECLO Website or SPECLO App.

If you are using the SPECLO Website:

  • Use of Cookies: The SPECLO Website uses cookies and similar technologies to maintain secure sessions, protect against misuse and analyse usage patterns.
  • Management of Cookies: Most web browsers are set to accept cookies by default. You can manage your cookie preferences through your browser settings. However, disabling cookies may affect the functionality and security of the SPECLO Website..

If you are using the SPECLO App:

  • Session Management: As a native application, the SPECLO App does not rely on traditional browser cookies for its core internal functionality. Instead, we use encrypted tokens stored in protected device storage to maintain your login session.
  • Authentication: We use third-party authentication providers for secure login. During the authentication process, your device’s system browser may temporarily use cookies to establish and verify your session.
  • Termination: You may terminate your active session and invalidate these tokens at any time by logging out within the SPECLO App.

5. Why Do We Collect, Hold, Use and Disclose Personal Information?

We collect, hold, use and disclose personal information for purposes that are reasonably necessary to undertake our business functions and activities, to deliver the Services to you, or as otherwise permitted under the Privacy Act. These purposes include:

  • Providing Products and Services: To provide you with our products and services, including personalised workout recommendations and artificial intelligence coaching features, and to help you track your fitness progress and generate insights;
  • Account Administration: To administer and manage the relationship between you and SPECLO, including processing registrations, maintaining accounts and responding to enquiries;
  • Communication: To communicate with you about updates, new features, promotions and other information relating to SPECLO and our products and services;
  • Contractual Performance: To perform our contractual obligations to you or to take steps at your request before entering into a contract;
  • Business Operations: To manage our business operations, including administration of the SPECLO App and SPECLO Website and to conduct business transactions;
  • Improvement of Services: To analyse, improve and develop our products, services, SPECLO Website and SPECLO App, including analysing usage patterns and feedback to determine how our users interact with our products and services;
  • Protection: To protect you, other third parties and our Services from misuse and bad actors, and to remove content that violates our Terms and Conditions. We may use automated tools, device information, log files and other information for these purposes;
  • Compliance: To comply with our legal and regulatory obligations, including record-keeping requirements and responding to lawful requests from government authorities; and
  • Direct Marketing and Push Notifications: To send you direct marketing communications (including via email, SMS, telephone or social media) and push notifications about our products and services in accordance with section 15 below.

If we did not collect your personal information, we may not be able to provide you with our products and services, or provide you with the full functionality of the SPECLO App.

6. Direct Marketing and Push Notifications

For the purposes of direct marketing communications and push notifications:

  • Consent: We will only send you direct marketing communications where you have consented or where we are otherwise permitted to do so. Additionally, we will only send you push notifications for promotional or marketing purposes (including special offers or new feature announcements) where you have opted-in to receive such notifications via a separate consent toggle within the SPECLO App settings. You may still receive non-marketing push notifications which are necessary for the provision of the Services (including account security alerts and technical updates);
  • Privacy of Health Information: We will not use your sensitive information related to health (such as your weight, height or fitness level) for direct marketing communications and we will not disclose such sensitive information to any third parties for their own direct marketing purposes; and
  • Opt-out: You can manage your preferences or opt-out of all or specific categories of direct marketing communications and push notifications at any time through the “Settings” menu in the SPECLO App, your device’s system settings or by using the unsubscribe instructions in our communications.

7. Who Do We Disclose Personal Information To?

We may disclose your personal information to the following parties:

  • Internal Business Units: Our internal business units and departments, including employees and contractors who require access to perform their roles;
  • Gym Operators: If you are a user of the SPECLO App, we may disclose your personal information to the operators of the gyms that you use, to enable them to provide services to you and manage their gym operations;
  • Third Party Service Providers: Third party service providers who provide services to us or help us operate our services, including cloud storage providers (such as Amazon Web Services), IT service providers, analytics providers, payment processors and marketing service providers. We take reasonable steps to ensure these providers comply with their privacy obligations;
  • With Your Consent: To any other parties where you have consented to the disclosure;
  • As Required by Law: To law enforcement agencies, government authorities, courts or other parties as required or authorised by law; and
  • Business Transactions: To prospective purchasers or investors in connection with a sale, merger, acquisition or other business transaction involving SPECLO.

8. Cross-Border Disclosure of Personal Information

Personal information collected by SPECLO is stored on servers located in Australia and the United States, including cloud storage servers operated by Amazon Web Services.

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the recipient does not breach the APPs in relation to that information. By providing us with your personal information and consenting to this Privacy Policy, you acknowledge that your personal information may be transferred to, stored and processed in countries outside Australia, including the United States.

9. How Do We Protect Personal Information?

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Our security measures include:

  • Encryption: We use encryption technologies to protect personal information during transmission and storage;
  • Access Controls: We implement access controls to limit access to personal information to authorised personnel who require access to perform their roles;
  • Physical Safeguards: We maintain physical safeguards to protect personal information stored in physical form and to secure our premises and systems;
  • Security Assessments: We conduct regular security assessments and audits to identify and address potential vulnerabilities; and
  • Compliance with Standards: We comply with applicable security standards and industry best practices to protect personal information.

While we take reasonable steps to protect your personal information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the absolute security of your personal information.

10. How Long Do We Retain Personal Information?

We retain personal information for as long as necessary to fulfil the purposes for which it was collected, or as required or permitted by law. We will take reasonable steps to destroy or de-identify personal information when it is no longer needed for any purpose for which it may be used or disclosed under the Privacy Act.

11. Children

Our Services are intended only for persons who are at least 13 years old, or such higher age as may be required in your jurisdiction. If you are under the legal age to form a legally binding contract in your jurisdiction, you may only use the Services if you have the permission of your parents or legal guardians to access and use the Services.

If you are under the legal age to form a legally binding contract in your jurisdiction and your parents or legal guardians do not give us permission to collect, use and disclose your personal information for the purposes outlined in this Privacy Policy, you should immediately cease using the Services. If you are a parent or legal guardian and you wish to have your child’s personal information deleted, you can contact us using the details set out in section 15 below.

12. Anonymity and Pseudonymity

Where practicable, you may have the option of not identifying yourself or using a pseudonym when dealing with us. However, if you do not provide us with certain personal information, we may not be able to provide you with our products and services, or provide you with the full functionality of the SPECLO App.

13. Accessing and Correcting Your Personal Information

You have the right to request access to the personal information we hold about you. You also have the right to request the correction of any personal information that is inaccurate, out of date, incomplete, irrelevant or misleading.

To request access to or correction of your personal information, please contact us using the details set out in section 15 below. We will respond to your request within a reasonable period. In some circumstances, we may refuse to provide access or make corrections, as permitted by law. If we refuse your request, we will provide you with written reasons for the refusal and the mechanisms available to complain about the refusal.

We will not charge you for making a request to access or correct your personal information. However, we may charge a reasonable fee to cover our costs of locating and retrieving the information if the request is complex or voluminous.

As set out in our Terms and Conditions, you also have the right to terminate your SPECLO App account at any time by contacting us at contact@speclo.com.au or through the account settings in the SPECLO App. Upon termination, all of your personal information that is no longer needed for any purpose for which it may be used or disclosed under the APPs will be securely destroyed or de-identified; however, SPECLO may be required to retain certain personal information in accordance with applicable laws (including applicable data retention and privacy laws).

14. Complaints

If you believe that we have breached your privacy, the Privacy Act or the APPs, you may lodge a complaint with us by contacting us using the details set out in section 15 below. We will investigate your complaint and respond to you in writing within a reasonable period, generally within 30 days.

15. Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements or other factors. We will notify you of any material changes by posting the updated Privacy Policy on the SPECLO Website and SPECLO App and, where appropriate, by notifying you directly. We encourage you to review this Privacy Policy periodically to stay informed about how we protect your personal information.
